Data privacy

General provisions

T-Systems International GmbH attaches great importance to protecting your personal data. We always inform you what personal data we collect, how your data is used, and how you can influence the process.

1. What data is recorded, how is it used and how long is it stored?

a) Technical characteristics: When you visit our websites, the web server temporarily records the domain name or IP address of your computer, the client's file request (file name and URL), the http response code and the website from which you are visiting us.
The logged data is used exclusively for data security purposes, in particular to defend against attempted attacks on our web server (Art. 6 para. 1 f DSGVO). They are neither used to create individual user profiles nor passed on to third parties and are deleted after 7 days at the latest. We reserve the right to statistically evaluate anonymised data records.

b) User surveys/customer feedback with GetFeedback: These websites use the service of SurveyMonkey Europe UC, 2 Shelbourne Buildings, 2nd Floor, Shelbourne Road, Ballsbridge, Dublin 4, Ireland for customer surveys (note: SurveyMonkey has taken over the previously used company Usabilla and its tool of the same name). Website ratings as well as your feedback can be requested (Art. 6 para. 1 a DSGVO). The opinions and suggestions for improvement of our customers are important components for the improvement of our websites. Only anonymous information is processed and there is no possibility to draw conclusions about the sender. At no time are personal or personalisable data transmitted. We store and evaluate the data for 24 months. The surveys can be conducted in two different ways:

  I) The feedback button on the website. You can use this button to give us your feedback at any time. If you do not use this function, no data will be transmitted.
  II) An active feedback request can also be displayed on the website. You can deny this request or cancel it at any time. The answers will only be sent when the survey is completed by you.

c) Text Chat: If you use the text chat on the TelekomCLOUD website to contact customer service, various information is transmitted to the chat system (Art. 6 para. 1 b, f DSGVO) and deleted after 7 days. This includes, for example, your IP address, browser version, operating system version; this data cannot be viewed by our customer advisor. The data generated during the service chat is transferred to our CRM system (Salesforce Service Cloud). The CRM system is operated by Salesforce Inc. and hosted in Europe. The chat content is deleted after 24 hours at the latest due to the system. Additional chat data (start time, duration of the chat, internal notes, any customer information requested in the chat) is anonymised after 28 days.
In addition, information about the accessibility of the chat service is transmitted from the chat platform to the TelekomCLOUD website at regular intervals. This information is used to activate or deactivate the button for starting the text chat on the website.

d) TelekomCLOUD marketplace: We use your personal data only for the purpose of technical administration of the websites and to fulfil your wishes and requirements. Additional personal data, such as your name, address, telephone number or e-mail address, is not collected unless you provide this information voluntarily or in connection with registration on the TelekomCLOUD marketplace. The data obtained from you when contacting us, the scope of which can be found in the contact form, will be processed exclusively for the purpose of responding to your enquiry and providing the service by Telekom Deutschland GmbH. We will only use this data for product-related surveys and marketing purposes if you have given us your prior consent - but only to the extent necessary for each specific case and in accordance with the consent given. Personal data is only passed on to third parties with the express consent of the person concerned. Our contractual partners are contractually obliged by us to treat your data confidentially and in accordance with the statutory provisions. You can decide whether we may use your data for our own marketing purposes when you register. You will only receive advertising information from us if you consent to such use. You have the option to object to such use at any time and to revoke any consent you may have given.
If you register, we process and use the contract data collected when the contract is concluded and during the term of the contract, which are necessary for the mutual, proper fulfilment of the contract, as well as the voluntary information (contract data). Contractual data includes salutation, surname and first name, address, date of birth, telephone number and / or e-mail addresses, data on payment processing and turnover data - differentiated according to the services used, products and information about the products you use. If you set up additional users, their data will also be stored. Your contractual data will only be stored beyond the end of the contractual relationship in accordance with the contractual agreements and will be limited to the minimum required in each case. We store the text of the contract and send you the order data by e-mail. Your contractual data will be deleted at the latest 90 days after the end of the contractual relationship by deleting your user account.

Usage and billing data: We store and use billing data for the proper provision of our services and for billing purposes. Billing data includes information about the start and end of individual use and the services used.

Processing of customer data with Salesforce: In order to process customer service requests and to communicate with customers by e-mail or telephone in accordance with the consent you have given us, your personal customer data will be stored and processed in our CRM system (Salesforce Service Cloud & Salesforce Marketing Cloud). The CRM system is operated by Salesforce Inc. Your personal data is always encrypted and is therefore not accessible to Salesforce itself.
If you have given us your consent, we will collect email usage information (sends, opens, clicks) via this system in order to improve our service for you and to send you more appropriate information. If you no longer agree to this, you can object to this at any time under "My settings".

e) For the legitimation check in the context of a contract conclusion, we use the Video Ident service of the order processor Purpleview GmbH, Kampstraße 6, 44137 Dortmund (Art. 6 para. 1 b DSGVO) within the video chat. For video chat and video ident, a session cookie is set for the duration of the web session, which is deleted at the end of the web session. We only store the information about the session, in particular the start and end of the session for 7 days. Video content is not stored.

f) Fraud prevention: To prevent fraud in our webshop, we have commissioned the company Risk.Ident GmbH to provide the service (Art. 6 para.1 b DSGVO). Risk.Ident collects and processes data on the web pages of our web shop with the help of cookies and tracking technologies to determine the terminal device used by the user. Insofar as IP addresses are collected by Risk.Ident, these are immediately anonymised. The data processed by Risk.Ident is stored in a fraud prevention database. We access this as part of the ordering process for the purpose of risk assessment. In addition, we transmit data on end devices from which (attempted) fraud has already occurred to Risk.Ident. At no time is the data assigned to a person.

g) Stay logged in: If you log in with your e-mail address or mobile phone number and your password, the browser can remember this information. As soon as you activate the checkbox, you do not have to log in again every time you want to use your Telekom account. Nevertheless, you will be asked to enter your password again if you have not used the Telekom login for longer than 6 months or if special personalised services request this. 
You can log out of your Telekom account at any time by clicking on the "Log out" link located in the navigation bar. Once you are logged out, you can log in again and re-enable or disable the checkbox.

h) Other: Additional personal data, such as your name, address, telephone number or e-mail address, will not be collected unless you provide this information voluntarily.

2. Data control for the social media plug-ins or links to social media platforms used

Some of the offer pages contain buttons from social media networks (such as Facebook, Google, Instagram Twitter, Pinterest, Xing or LinkedIn), which you can use to recommend Telekom Deutschland GmbH offers to your friends and acquaintances. To ensure that you have full data control, the buttons used only establish direct contact between the respective social network and the visitor when you actively click on the button (1-click solution).

On our websites, we use the pictograms of the respective social media network. Only when you click on the pictogram are you directed to the company page on the respective social media platform. The social media platforms as well as the third-party content providers that can be reached via the pictograms provide these services and the processing of their data under their own responsibility.

By activating the social media plug-in or link via the pictogram, also for sharing content, (Art. 6 para. 1 a DSGVO) the following data may be transmitted to the social media providers: IP address, browser information, operating system, screen resolution, installed browser plug-ins such as Adobe Flash Player, previous website if you followed a link (referrer), the URL of the current website, etc. The next time you visit the website, the social media plug-ins are provided again in the pre-set inactive mode, so that when you visit the website again, it is ensured that no data is transmitted. Further information on social media plug-ins regarding the scope and purposes of the respective data processing as well as further information relevant to data protection can be found in the data protection declarations of the respective responsible party as well as the 1-click solution.

3. Will my usage habits be evaluated, e.g. for advertising purposes, tracking?

Explanations and definitions

We want you to enjoy using our websites and making use of our products and services. We have an economic interest in this. In order for you to find the products that interest you and for us to be able to design our websites in a user-friendly way, we analyse your usage behaviour anonymously or pseudonymously. Within the framework of the legal regulations, we, or companies commissioned by us within the framework of order processing, create usage profiles. It is not possible to draw any direct conclusions about you. In the following, we will inform you in general about the various purposes. You have the option of agreeing to or rejecting the use of cookies via the cookie query that appears when you visit our website. Cookies that are required to provide the web service (see explanation above under 1.) cannot be rejected.

Tag management (required)
Tag management is used to manage tracking tools in websites. A tag is set for each page to do this. Based on the tag, the system can determine which tracking tools should be used for this page. Tag management can be used to specifically control tracking so that the tools are only used where appropriate.

Market research / Reach measurement (opt-in)
Reach measurement provides statistics on a website’s usage intensity and the number of users, along with comparable figures for all the connected services. Individual users are not identified at any time. Your identity is always protected.

Profiles for designing the web portal based on needs (opt-in)
We use clickstream analysis to improve our websites constantly. The clickstream corresponds to your movement path on the websites. Analyzing the movement paths provides us with an insight into usage habits on our websites. This lets us identify possible structural errors in the websites and thus improve the websites so they are optimally tailored to your needs. Individual users are not identified at any time.

Profiles for personalized recommendations (opt-in)
T-Systems provides you with personalized action and click recommendations for offerings, services or products.  To do so, the service provider creates a pseudonymized profile about the services and websites you access on the Internet and assigns categories to this profile. The system displays content or information that matches your profile. At no time are individual users identified or personal data used for the profile.

Cross-device and cross-partner profiles for interest-based display of advertising and web content (opt-in)
Among other things, we collect information on your usage behaviour via our websites and, when you are logged in, also contract information on purchased products, tariffs or options, as well as contract periods, in order to be able to display web content and online advertising in a more interest-oriented manner. In order to be able to implement this across devices and providers, we work together with partners.

In order to process customer service enquiries about the TelekomCLOUD and for customer communication by e-mail or telephone, in accordance with the consent you have given us, we store and process your personal customer data in our CRM system (Customer-Relation Management) from Salesforce Inc.

a) Required cookies
These cookies are necessary for you to navigate the pages and use essential functions. They enable basic functions such as order processing in the online shop and access to secure areas of the website. In addition, they serve the anonymous evaluation of user behaviour, which is used by us to continuously develop our website for you. d) Marketing Cookies/ Retargeting 
These cookies and similar technologies are used to show you personalised and therefore relevant promotional content. This is done not only on Telekom Deutschland GmbH websites, but also on other advertising partner sites (third-party providers). On individual web pages, e.g. in the Shopfinder, which you can reach via the navigation in the "Service" section under "Shops" at the top of the Telekom product pages, we use Google Maps to display maps, locations and for route planning. Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. By embedding Google Maps, your IP address is transmitted directly to Google and a cookie is stored as soon as you visit such a website. You can find out about and object to data processing by Google at any time at http://www.google.de/intl/de/policies/privacy.

We use the remarketing and Google AdWords function of Google Inc. ("Google"). This function is implemented via a cookie and is used to present interest-based advertisements to website visitors as part of the Google advertising network. On these pages, the visitor can then be presented with advertisements that relate to content that the visitor has previously accessed on websites that use Google's remarketing function. According to its own information, Google does not collect any personal data during this process. However, if you do not wish to use Google's remarketing function, you can deactivate it in principle by making the appropriate settings at http://www.google.com/settings/ads. Alternatively, you can deactivate the use of cookies for interest-based advertising via the advertising network initiative by following the instructions at http://www.networkadvertising.org/managing/opt_out.asp. If you have accessed our website via a Google ad, Google AdWords will store a cookie on your computer. This cookie loses its validity after 30 days. It is not possible to draw any conclusions about your person. The information obtained with the help of this so-called conversion cookie is used to compile statistics about our conversion rate. This means that we learn how many users have come to our websites through a Google ad and purchase a product within 30 days. If you do not wish to participate in the tracking process, you can disable cookies for conversion tracking by setting your browser preferences to block cookies from the relevant domain: Google AdWords: googleadservices.com

Facebook
We use the Facebook service Customer Audience and the Facebook Pixel on our websites to optimise our advertising offer, provided you have given Facebook your consent. Further information about these Facebook services and the privacy policy of Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook") can be found at the link https://www.facebook.com/privacy/explanation.

If you use a Facebook user account, this can be recognised by the Facebook pixel on our websites by means of the Facebook cookie that is set, via which the collected usage data is transmitted to Facebook for analysis and marketing purposes. You can check and/or deactivate this data collection and the further processing and use of the data by Facebook directly at Facebook. The Facebook pixel is a JavaScript code that transmits the following data to Facebook:

  • HTTP header information (including IP address, web browser information, page location, document, web page URL and web browser user agent, referrer URL and day and time of use).
  • Pixel-specific data; this includes the pixel ID and Facebook cookie data, including your Facebook ID (this data is used to link events to a specific Facebook ad account and associate them with a Facebook user)
  • Additional information about visits to our websites, as well as standard and custom data events.

The aforementioned data processing only concerns users who have an account with Facebook or who have accessed a Facebook partner page (whereby a cookie has been set). The display of advertisements on Facebook (partner) pages using the "Customer Audience" service does not affect users who are not members of Facebook. If the Facebook ID contained in the Facebook cookie can be assigned to a Facebook user, Facebook assigns this user to a target group ("Custom Audience") on the basis of the rules defined by us, provided that the rules are relevant. We use the information obtained in this way to present Telekom advertising on Facebook (partner) pages. If you wish to object to the use of the Facebook Pixel, you can set an opt-out cookie with Facebook or deactivate JavaScript in your browser. LinkedIn
Re-targeting and conversion tracking by LinkedIn (LinkedIn Ireland, Wilton Plaza, Wilton Place, Dublin 2, Ireland) by means of the LinkedIn Insight Tag enables the collection of statistical, pseudonymous data (referrer URL, IP address (shortened), device and browser characteristics) about website visits and the use of our website and to provide corresponding aggregated statistics on this basis. In addition, this information is used to be able to display interest-specific and relevant offers and recommendations after you have shown interest in certain products, information and offers on our website. This anonymous information is stored in a cookie for 6 months. emetriq GmbH
emetriq is a provider of targeting services in the field of online marketing of advertising space. Targeting stands for precise addressing of target groups in online marketing. For this purpose, emetriq operates a data pool whose goal is to significantly increase the quality of targeting so that advertisers can display relevant advertisements according to their interests. To enable user-specific advertising to be displayed, emetriq GmbH, Vorsetzen 35, 20459 Hamburg, Germany, collects information about surfing behaviour and app usage. Cookies, measuring pixels, APIs or SDKs are used, which can collect or process the following information:

  • Cookie ID, Identifier for Advertising (IDFA) or Advertising ID (AdID)
  • Information from the app or browser, for example browser ID, time zone, language, operating system
  • Information about advertising banners seen or clicked on
  • URL of the websites visited by our affiliated marketers
  • Surfing behaviour in the online shop, for example, which article categories and which article descriptions were viewed
  • Socio-demographic data, such as age decades, form of address and abbreviated postcode
  • Hashed login data (e-mail)
  • etc.

If a user uses two or more browsers on his or her end device, a corresponding number of cookies will be generated on the end device. All information collected about a user is stored exclusively with this pseudonymous ID. emetriq deletes this data after 6 months at the latest.

6. What rights do I have?

You have the right,
a) To request information on the categories of personal data concerned, the purpose of the processing, any recipients of the data, the envisaged storage period (Art. 15 GDPR);
b) To request incorrect or incomplete data is rectified or supplemented (Art. 16 GDPR); 
c) To withdraw consent at any time with effect for the future (Art. 7 (3) GDPR);
d) To object to the processing of data on the grounds of legitimate interests, for reasons relating to your particular situation (Art 21 (1) GDPR);
e) To request the erasure of data in certain cases under Art. 17 GDPR – especially if the data is no longer necessary in relation to the purposes for which it was collected or is unlawfully processed, or you withdraw your consent according to (c) above or objected according to (d) above; 
f) To demand under certain circumstances the restriction of data where erasure is not possible or the erasure obligation is disputed (Art. 18 GDPR);
g) To data portability, i.e. you can receive your data which you provided to us, in a commonly used and machine-readable format, such as CSV and can, where necessary, transmit the data to others (Art. 20 GDPR);
h) To file a complaint with the competent supervisory authority regarding data processing (for telecommunications contracts: the German Federal Commissioner for Data Protection and Freedom of Information (Bundesbeauftragte für den Datenschutz und die Informationsfreiheit); for any other matters: State Commissioner for Data Protection and Freedom of Information North Rhine-Westphalia (Landesbeauftragter für den Datenschutz und die Informationsfreiheit Nordrhein-Westfalen).

7. Who does T-Systems share my data with?

To processors, i.e. companies that we commission with the processing of data within the scope provided for by law, Art. 28 DSGVO (service providers, vicarious agents). In this case, T-Systems remains responsible for the protection of your data. We commission companies in the following areas in particular: IT, sales, marketing, finance, consulting, customer service, human resources, logistics, printing.
To cooperation partners who provide services for you or in connection with your T-Systems contract on their own responsibility. This is the case if you commission services from such partners from us or if you consent to the involvement of the partner or if we involve the partner on the basis of legal permission.
Due to legal obligation: In certain cases, we are legally obliged to transmit certain data to the requesting government agency.

8. Where is my data processed?

Your data is processed in Germany and in other European countries. If, in exceptional cases, your data is also processed in countries outside the European Union (in so-called third countries), this will take place,

  1. insofar as you have expressly consented to this (Art. 49 para. 1a DSGVO). (In most countries outside the EU, the level of data protection does not meet EU standards). This applies in particular to comprehensive monitoring and control rights of state authorities, e.g. in the USA, which disproportionately interfere with the data protection of European citizens,
  2. or insofar as it is necessary for our provision of services to you (Art. 49 para. 1 b DSGVO),
  3. or insofar as it is provided for by law (Art. 6 para. 1 c DSGVO).
